By downloading, installing, or using the Check My Truck mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.
2. Description of Service
Check My Truck provides a comprehensive truck inspection and maintenance management solution. The App allows users to conduct digital inspections, track maintenance schedules, manage compliance requirements, and monitor fleet operations.
3. User Accounts and Registration
3.1. You may be required to create an account to access certain features of the App.
3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.3. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary.
3.4. You must notify us immediately of any unauthorized use of your account.
4. User Responsibilities
You agree to:
- Use the App only for lawful purposes and in accordance with these Terms
- Not use the App in any way that could damage, disable, overburden, or impair our servers or networks
- Not attempt to gain unauthorized access to any portion of the App or any other systems or networks
- Ensure that all inspection data and information entered is accurate and truthful
- Comply with all applicable laws and regulations regarding vehicle inspection and maintenance
5. Intellectual Property Rights
5.1. The App and its entire contents, features, and functionality are owned by Check My Truck and are protected by international copyright, trademark, and other intellectual property laws.
5.2. You are granted a limited, non-exclusive, non-transferable license to use the App for your personal or business purposes.
5.3. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any of the material on our App without prior written consent.
6. Data and Privacy
Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information.
7. Subscription and Payment
7.1. Certain features of the App may require a paid subscription.
7.2. Subscription fees are charged in advance on a recurring basis (monthly or annually).
7.3. All payments are processed through the respective app store (Google Play Store or Apple App Store) and are subject to their terms and conditions.
7.4. You may cancel your subscription at any time, but no refunds will be provided for partial subscription periods.
8. Disclaimer of Warranties
8.1. The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.
8.2. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
8.3. While we strive to provide accurate information, we make no representations or warranties regarding the accuracy, reliability, or completeness of any content or information provided through the App.
8.4. The App is a tool to assist with vehicle inspection and maintenance management, but should not replace professional mechanical advice or legally required inspections.
9. Limitation of Liability
9.1. To the fullest extent permitted by applicable law, Check My Truck shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App.
9.2. Our total liability to you for all claims arising from your use of the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Check My Truck and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the App or your violation of these Terms.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
12. Termination
12.1. We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.
12.2. Upon termination, your right to use the App will immediately cease.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
